Может ли единщик сдавать недвижимость как физлицо-непредприниматель

Чи може фізична особа, яка має у власності нерухоме майно нежитлового призначення загальною площею 400 кв. м. надавати 110 кв. м. в оренду як фізична особа, а решту 290 кв. м., як фізична особа підприємець на спрощеній системі оподаткування?

Відповідь: Узагальнюючою податковою консультацією щодо застосування спрощеної системи оподаткування, обліку та звітності фізичними особами – підприємцями, які здійснюють діяльність з надання нерухомого майна в оренду, затвердженою наказом ДПС України від 20.02.2012 № 136, визначено, що фізична особа – підприємець не має права перебувати на спрощеній системі оподаткування. Така фізична особа може надавати нерухомість в оренду як фізична особа - підприємець за загальною системою оподаткування або як фізична особа не суб’єкт господарювання.
